Resúmen Este ensayo pretende contrastar las tesis de Michel Foucault sobre las relaciones de poder y las prácticas punitivas, con un caso judicial que involucra a una institución como el Ejército Argentino. Abordaremos el tema del poder desarrollando las prácticas punitivas, y plantearemos el caso judicial considerando las relaciones de poder en el Ejército. En el intento de cotejar las ideas de Michel Foucault sobre disciplina y penalidad, describiremos el dispositivo del juicio entablado al homicida y las consecuencias de la aplicación de la pena de muerte. Este trabajo plantea el caso judicial de Luis Leonidas Paz, cabo del Batallón de ingenieros de Combate 141, perteneciente al Ejército Argentino en la ciudad de Santiago del Estero. El cabo Paz fue condenado a la pena de muerte por el homicidio del jefe del Batallón, el mayor Sabela, el 2 de enero de 1935 en Santiago del Estero. Abstract This essay intends to contrast Michel Foucault’s thesis on power relations and punitive practices with a court case that involves an institution like the Argentine Army. We will deal with the question of power by developing the punitive practices and we will present the court case taking into account power relationships in the Army. In an attempt to compare Michel Foucault’s notions of discipline and penalty, we will describe the trial brought against the homicide and the consequences of the application of the death penalty. This work presents the court case against Luis Leonidas Paz, officer of the 141 Engineer Battalion (combat) of the Argentine Army in the city of Santiago del Estero. He was charged with the murder of major Sabela, chief of the battalion, and condemned to death penalty on January 2nd, 1935 in Santiago del Estero.
